1. Acceptance
By accessing or using FluentScore ("Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and FluentScore.
2. Service description
FluentScore provides AI-assisted TOEFL iBT practice tests. The Service is offered on a freemium basis: five full-length practice tests are available at no charge; additional tests and features require a paid Premium subscription.
FluentScore is an independent preparation platform and is not affiliated with, endorsed by, or associated with ETS (Educational Testing Service). TOEFL® is a registered trademark of ETS. Score predictions are indicative only and do not guarantee any result on the official exam.
3. Eligibility and accounts
- You must be at least 16 years old to use the Service.
- You must provide accurate information when creating an account.
- You are responsible for maintaining the security of your account. Do not share your credentials.
- One person per account. You may not create multiple accounts to circumvent access limits.
4. Subscription and billing
4.1 Premium subscription
The Premium plan grants access to the full test library and is billed monthly at the price displayed at checkout. Prices are in Euros (EUR) and include applicable VAT where required.
4.2 Auto-renewal
Your subscription renews automatically at the end of each billing period unless you cancel beforehand. By subscribing, you authorise FluentScore to charge the payment method on file for each renewal.
4.3 Cancellation
You may cancel at any time through the billing portal (accessible from your profile page). Cancellation takes effect at the end of the current billing period; you retain Premium access until then. We do not offer pro-rated refunds for partial periods.
4.4 EU statutory withdrawal right
If you are a consumer in the European Union, you have the right to withdraw from a subscription within 14 days of purchase without giving any reason (Directive 2011/83/EU, Art. 9). However, by explicitly requesting immediate access to the digital content (starting your first Premium test), you acknowledge that the right of withdrawal is lost once the digital content has been delivered (Art. 16(m)).

4.5 Price changes
We may change subscription prices with at least 30 days' advance notice. Continued use after the notice period constitutes acceptance of the new price.
5. Acceptable use
You agree not to:
- Scrape, copy, or redistribute test content or AI-generated feedback.
- Share account credentials or grant access to third parties.
- Attempt to reverse-engineer or extract AI prompts or scoring rubrics.
- Use the Service for any unlawful purpose or in violation of any applicable regulation.
- Circumvent technical measures that limit access to Premium content.
6. Intellectual property
All test content, AI prompts, scoring rubrics, and platform software are the property of FluentScore or its licensors. Your personal practice responses remain your own; by submitting them for AI evaluation you grant FluentScore a limited licence to process them solely to provide the Service.
7. Disclaimer of warranties
The Service is provided "as is" without warranty of any kind. We do not warrant that the Service will be uninterrupted, error-free, or that score predictions will match official TOEFL® results.
8. Limitation of liability
To the maximum extent permitted by applicable law, FluentScore's total liability to you for any claim arising out of or relating to these Terms or the Service is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable consumer protection law.
9. Termination
We may suspend or terminate your account if you breach these Terms. You may delete your account at any time by contacting contact@fluentscore.app. Upon termination, your right to use the Service ceases immediately; billing obligations that accrued prior to termination survive.
10. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by email or prominent notice in the Service at least 15 days before taking effect. Continued use after that date constitutes acceptance.
11. Governing law and disputes
These Terms are governed by French law. Any dispute that cannot be resolved amicably shall be submitted to the competent courts of France, without prejudice to any mandatory consumer protection rights you enjoy under the law of your country of residence within the EU.
